This website is operated by DeliverMyPrescription. Throughout the site, the terms “we”, “us” and “our” refer to DeliverMyPrescription. DeliverMyPrescription offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing a product from us from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Our store is hosted by a 3rd party. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

 

About Us

DeliverMyPrescription is licensed and operated by E-Gistics Limited (E-Gistics) a company incorporated in England and Wales under company number 08363853. Our VAT Number is GB 155 469 386. E-Gistics has operated in the delivery and logistics management sector for 6 years, fulfilling the shipping requirements of both business and individuals throughout the duration of its existence.

DeliverMyPrescription is a service that serves to connect patients with their local independent community pharmacies, and to facilitate the delivery of prescriptions using established courier networks. 

DeliverMyPrescription cannot take responsibility for any aspect of a pharmacy’s operations, including but not limited to; identity verification, approval/rejection of a requested prescription, dispensing of prescriptions, packaging of prescriptions.

DeliverMyPrescription is unable to offer any advice that is supplementary to the advice that is found within this website. Queries relating to any aspect of the pharmacy’s processes delineated above should be directed in the first instance towards one’s local pharmacy.

DeliverMyPrescription is only able to process requests for prescriptions from, or on behalf of, those who are eligible for free prescriptions or who have arranged prepayment of their prescriptions through a valid Prescription Prepayment Certificate (PPC). By engaging with our service, you accept that you, or the individual on behalf of whom you are acting, are eligible under the terms delineated here. Pharmacies reserve the right to refuse a request for a prescription that has been submitted with incorrect, or insufficient, evidence of eligibility. Further information regarding the evidence that must be submitted can be found in Section 4 of these Terms and Conditions.

DeliverMyPrescription cannot process requests for prescriptions from, or on behalf of, individuals that are not eligible for free or PPC prescriptions at this time. 

DeliverMyPrescription does not store any of your personal or billing information on internal servers. Personal and billing information, alongside corresponding liabilities, are passed on to other actors for storage. The exact nature of this transfer is delineated in Section 4 of these Terms and Conditions.

 

  1. ONLINE STORE TERMS

1.1 You acknowledge that you are over the age of 18 at the time of purchase. You may order prescriptions on behalf of an individual who is below the age of 18, provided you are, or have obtained the express permission of, their parent or registered guardian.

1.2 You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

1.3 You must not transmit any worms or viruses or any code of a destructive nature.

1.4 A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

  1. GENERAL CONDITIONS 

2.1 We reserve the right to refuse service to anyone for any reason at any time.

2.2 You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 

2.3 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

2.5 We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

2.6 You accept that this website is provided with no guarantee that its service will be uninterrupted or error-free.

 

  1. MODIFICATIONS TO THE SERVICE AND PRICES 

3.1 Prices for our products are subject to change without notice.

3.2 We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

3.3 We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

  1. ACCURACY OF BILLING AND PERSONAL INFORMATION

4.1. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.  

4.2 You agree that you must enter the exact name and address that you, or the individual on behalf of whom you are acting, have registered with your local pharmacy and NHS. If you have arranged for the prepayment of our prescriptions using the Prescription Prepayment Certificate (PPC) scheme, you must provide the corresponding reference number as evidence of your eligibility for this service. 

4.3 You agree to not impersonate any individual or entity, or intentionally use a false name or address in order to knowingly defraud any individual or entity involved in any stage of this transactional process. You should obtain the express consent of any individual on behalf of whom you intend to act before placing any order.

4.3 Pharmacies reserve the unrestricted right to refuse your request for a prescription. They may contact you following a refusal to request additional/alternative information that will allow the dispensing of your prescription.

4.4 You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

4.5 We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

 

  1. POSTAGE AND DELIVERY

5.1 DeliverMyPrescription will act to facilitate the provision of appropriate packaging to all pharmacies that have undertaken the full onboarding process and accepted our Terms and Conditions of Service. DeliverMyPrescription accepts no responsibility for the dispensing pharmacy’s adherence to the packaging guidelines outlined by our courier partners and can accept no liability for any loss or damage caused to a prescription by incorrect, insufficient or inadequate packaging.

5.2 We accept no liability for the receipt of a prescription that does not match that which was requested in during the booking stage. Liability, in this case, rests with the dispensing pharmacy. Resolution of such an incident cannot be conducted through DeliverMyPrescription, and the matter must instead be addressed directly with the dispensing pharmacy.

5.3 We accept no liability for the damage or loss of a prescription that occurs as a result of transit through your chosen courier network. Liability, in this case, rests with the courier in question.

5.4 The timing of the Service selected is contingent upon the dispensing pharmacy's acceptance of an order and scheduling of a courier pickup. The time window of a timed service begins once a prescription request has been reviewed and approved, and a pickup scheduled, by the dispensing pharmacy. No liability shall be apportioned to DeliverMyPrescription in the case that the timing window selected by a customer is exceeded as a result of inactivity on behalf of the pharmacy.

  1. REFUNDS, CANCELLATIONS AND AMENDMENTS

6.1 You have a statutory right to cancel or amend the Service(s) you have purchased. Cancellation and amendment are only possible before collection has been made by your chosen courier. 

6.2 If you wish to cancel to cancel the Service, please inform us by doing the following; 

  1. Contact us via our Help Centre at help.delivermyprescription.co.uk, click 'Submit a ticket' and select ‘I have a question about my order’. 
  2. Fill in the requisite fields, providing some key identifiers, enter a description of your reason for cancellation.
  3. Await a response from a member of the DeliverMyPrescription team. If your order has already been accepted, we strongly encourage you to contact your pharmacy directly to request that your order be halted. If your request for a prescription has already been accepted and dispatched, DeliverMyPrescription is unable to intervene and you must take delivery of the prescription. 

6.3  If you wish to amend the Service, please inform us by doing the following;

  1. Contact us via our Help Centre at help.delivermyprescription.co.uk, click 'Submit a ticket' and select ‘I have a question about my order’
  2. Fill in the requisite fields, providing any necessary key identifiers, and give a comprehensive description of the amendment you wish to make to the Service.
  3. Await a response from a member of the DeliverMyPrescription team. If the amendment can be successfully made, we will forward  a replacement label directly to your local pharmacy as per the Service agreement. 

6.4 DeliverMyPrescription offers a standard product insurance of £10 per product per customer, that may be claimed in the case of the loss of a prescription. Payment of this discretionary amount does not constitute a concession of liability on behalf of DeliverMyPrescription, or any of our partners. If we are contacted by the courier informing us of the loss of your prescription in transit, we will automatically issue a credit in line with this policy to the payment method registered at checkout. If you wish to register a claim as your prescription has not arrived, it must be registered within 14 days of the (due) delivery date. In order to raise a claim against your shipment, please inform us by doing the following;

  1. Contact us via our Help Centre at help.delivermyprescription.co.uk, click 'Submit a ticket’ and select 'My prescription has not yet arrived'
  2. Fill in the requisite fields, providing any necessary key identifiers.
  3. Await a response from a member of the DeliverMyPrescription team.

6.5 We reserve the right to refuse a claim registered against loss of a prescription for reasons including, but not limited to; insufficient evidence, claim registered outside the 14 day window

6.6 If the claim for the loss of your prescription is ratified by a member of the DeliverMyPrescription reimbursement of the value of your product (up to a maximum limit of £10) will be actioned within 30 days of the submission of your claim. Funds will be reimbursed directly via the payment method registered on checkout.

6.7 In the case of a prescription arriving damaged such that its contents has been rendered unusable, DeliverMyPrescription follows the procedure delineated by our courier partners, that can be found in their Terms and Conditions. In order to raise a claim against the damage of your shipment, please inform us by doing the following;

  1. Contact us via our Help Centre at help.delivermyprescription.co.uk, click 'Submit a ticket', selecting ticket type 'My prescription is damaged'
  2. Fill in the requisite fields, providing any necessary key identifiers (name, address, etc.) as well as a description of the damage. Please also include a comprehensive set of pictures of the damage to substantiate your claim.
  3. Await a response from a member of the DeliverMyPrescription team.

 6.8 Due to the nature of the goods in transit, our courier partners reserve the right to refuse to deliver your shipment by any alternative means, including but not limited to; delivering to a neighbour, leaving in a designated safe place, upgrading your delivery to nominated-day delivery. Our courier partners will make 3 delivery attempts before your shipment is held in your local delivery depot pending contact and provision of additional instructions.

  1. OPTIONAL TOOLS 

7.1 We may provide you with access to third-party tools over which we neither monitor nor have any control nor input

7.2 You acknowledge and agree that we provide access to such tools “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

7.3 Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

7.4 We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

 

  1. THIRD-PARTY LINKS

8.1 Certain content, products and services available via our Service may include materials from third-parties.

8.2 Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

8.3 We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

 

  1. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITIES

9.1 We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

9.2 You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

9.3 You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied. 

9.4 In no case shall DeliverMyPrescription, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 

  1. INDEMNIFICATION

10.1 You agree to indemnify, defend and hold harmless DeliverMyPrescription and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

  1. SEVERABILITY

11.1 In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

  1. TERMINATION AND OVERVIEW

12.1 The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 

12.2 These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

12.3 If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof). 

12.4 The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

12.5 Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
